Right of withdrawal
Customers who are consumers within the meaning of Directive 2011/83/EU have the right to withdraw from this contract within 14 days without providing any reason. The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, has taken possession of the goods. To exercise your right of withdrawal, you must inform us (emil 1868 GmbH, Bahnhofstraße 8, 4910 Ried im Innkreis, Tel: +43 7752 82080, Email: office@emil1868.com) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, fax, or email). You can use the attached sample withdrawal form for this purpose, but it is not mandatory. To meet the withdrawal deadline, it is sufficient that you send the notification of exercising the right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
If the customer withdraws from the contract with emil 1868 GmbH, emil 1868 GmbH must reimburse the customer for all payments received from the customer, including delivery costs (except for additional costs resulting from the customer’s choice of a different delivery method than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day the notice of withdrawal from the contract was received by emil 1868 GmbH. The same payment method used for the original transaction will be used for the refund unless expressly agreed otherwise with the customer; in no case will the customer be charged fees for this refund. emil 1868 GmbH may withhold the refund until it has received the goods back or until the customer has provided proof that the goods have been returned, depending on which occurs first. The customer must return the goods without delay and in any case no later than fourteen days from the day emil 1868 GmbH was informed of the cancellation of the contract. The deadline is met if the customer sends the goods before the fourteen-day period has expired. The customer bears the direct costs of returning the goods. The customer is only responsible for any loss in value of the goods if this loss in value is due to handling that is not necessary to examine the nature, characteristics, and functioning of the goods.
No right of withdrawal exists for:
- Goods that are liable to deteriorate rapidly or whose expiration date is quickly exceeded;
- Goods that are made to the customer’s specifications or are clearly tailored to personal needs;
- Goods that are delivered sealed and are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;
